WILD GOAT EVENT TERMS AND CONDITIONS

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. BY PROCEEDING WITH REGISTERING FOR THE EVENT, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE CAREFULLY READ AND FULLY UNDERSTOOD THE TERMS AND CONDITIONS AND AGREE TO THE TERMS SET FORTH BELOW.

In these Conditions:

“Fees”  means the fee for entry into the event (including the processing fee) as stated on the Registration Form;

“Partners” means any event partner of DS Media & Events Limited from time to time;  

“Event” means the event as organised by DS Media and Events Limited taking place on the  Race Date;

“Event Date” means the date of the Race stated on the Registration Form;

“Registration Form” means the page on the DS Media and Events Limited website which must be completed by you as the event participant prior to participation in the event and which incorporates these Conditions; 

“we/us/our” means DS Media and Events Limited; and

“you” means you the person named in the Registration Form as the event participant.

1.0 GENERAL

1.1 By paying the Fees you agree to participate in the event and be bound by these Conditions.

1.2 Participants will be allocated a coloured bib number with corresponding chip based on their age. You must be at least 11 years of age to take part in any of the runs that take you off site and at least 16 years old for any of the bike rides that take place off site. There will be further guidance issued on age restrictions for the individual events on the event pages. If you have any questions please email info@eventsofthenorth.com

For Paula’s Families on Track each team must have a minimum of 3 and a maximum of 5 members. At least one member of your team must be over 18 years of age, at least one member under 16 years and the minimum age to take part is 4 years old.

If you are not yet 18 years of age on the date of submission of the Registration Form you agree that you have submitted the requisite parental consent as set out on the Registration Form. Age guidance for other activities included across the festival weekend will be advised in your event guide and by the crew at each location. In the event that your address changes after you pay the Fees, please inform us of the address change by sending an e-mail to the following address: info@eventsofthenorth.com. Information packs will start to be issued no less than 2 weeks prior to the event date and will be issued to the email address provided at the point of registration.

1.3 You will receive details of event start times and locations in your information pack. All participants will be expected to register when they arrive to site. At registration, you will be issued with an electronic chip to record your time in all of the timed events. This should be used in accordance with the information in the information pack. Your timing chip will be valid across all timed events and should be kept in a safe place. You may be charged for a replacement.

1.4 You must comply with any and all instructions issued by crew and stewards at all times.

1.5 The event is subject to license. All start/finish times published are estimates and subject to change at the discretion of the event organisers. Whilst the organisers will make every effort to ensure the full event schedule takes place, the organiser holds the right to amend or cancel one or more of the events, attractions or performances for due reason. Tickets are purchased for the full festival and not on the basis of a single event or performance.

1.6 Ticket holders accept that there will be loud music throughout some of the events and performances and should accept that prolonged exposure can damage hearing. Strobe lighting, lasers and other special effects may be used in some of the performances.

1.7 The Wild GOAT Festival site is a no-smoking site.

1.8 Wild GOAT is an outdoor event and all in attendance are expected to bring suitable clothing and footwear for the duration of their stay. No refunds will be given due to inclement weather.

2.0 FILMING, PHOTOGRAPHY & CCTV

All ticket holders consent to being photographed, filmed and sound recorded throughout the duration of the festival. You agree to: (i) that we or any third party appointed by us, may photograph and/or film your participation in events or presence on site; and (ii) to the unlimited use in all current and future media (including, print, audio visual, the internet and social media channels) by us of your name, likeness, image (or any other means by which you may be identified) in connection with production, organisation, promotion and/or marketing of any of our events, including the races. 

3.0 TRADING & COMMERCIAL ACTIVITY

Only those specifically authorised by the event organisers are permitted to undertake trading, marketing or commercial activity at the event. You should not bring on to site any promotional or marketing materials unless authorised.

4.0 EVENT SAFETY / RACE RULES

4.1 At all times during the event you must adhere to all instructions given by the event crew and officials.

4.2 It is your responsibility to ensure that you have the correct equipment and clothing for the event, taking the weather conditions into account. You should ensure you wear appropriate footwear for the relevant terrain.

4.3 You are not permitted to be accompanied by pets or other animals in the races but well-behaved dogs are permitted on site.

4.4 Race numbers are required to participate in all of the races and must be visible on you top at all times throughout the race. You must hold a valid ticket in order to take part in the race. Your wristband will be used to identify this. You are strictly prohibited from swapping, selling or transferring your race number.

4.5 You are not permitted to use the following items in the Race:-

4.5.1   inline skates / roller skates;

4.5.2   wheelbarrows;

4.5.3    skateboards;

4.5.4    baby joggers;

4.5.5    Segways / hoverboards / ‘rideables’ of any form;

4.5.6    coaches / bikes / cycles; and/or

4.5.7    any other item that we, in our opinion, deem may cause danger or risk of danger to you or other participants.

4.6 Fancy dress costumes are permitted provided that they do not involve the carrying of large objects and will not restrict the individuals’ ability to move around the race course.

4.7 You must be in good health and physically prepared to take on the challenge of this event and you warrant to us that you are, and will be on the event date, sufficiently fit and healthy to participate in the Race unaided, and in accordance with these Conditions. If after your entry to the event has been accepted and you do not participate, no refund of the Fees (in whole or in part) shall be given to you in such circumstances.

4.8 We will use reasonable endeavours to provide you with a race finish time however we cannot be held responsible for any computer result anomalies or any technical malfunction.

4.9 We reserve the right to alter the start time of any of the events, the course distances, changes the race routes, changes the race dates and/or make any other changes to the event that, at our discretion, we consider necessary. In the event of any such change, we will use reasonable endeavours to notify you prior to the start of the event. No refund of the Fees (in whole or in part) shall be given to you in the event of any change to the event schedule, the event date and/or event format (whether or not you participate in the races or attend the event).

5.0 RACE EJECTION 

5.1 We withhold the right to refuse entry to the event or ask you to cease participation if:-

5.1.1 you fail to follow any instructions given by event crew / officials;

5.1.2 you attempt to participate in the event in a manner that we, believe:-

(a)  may cause injury to you;

(b)  may cause injury to another participant;

(c)  may damage or harm the environment;

(d)  is likely to cause offence; or

(e)  otherwise causes a risk or potential risk to health and safety including any failure, in whole or in part, to

comply with the restrictions in Condition 3 above (Event Safety); 

5.1.3 in our opinion you are unfit to race due to:-

(a) the consumption of alcohol;

(b)  the use of drugs;

(c)  an injury or illness; or

5.1.4 you fail to arrive at the start location at the specified time; or

5.1.5 you are unable to make sufficient progress in the Race to, in the opinion of the Race officials, allow you

to complete the Race within a reasonable time period; and in each such case as set out in these terms and

conditions, the Fees are non-refundable.

6.0 SPECIAL REQUIREMENTS & ACCESSIBILITY

6.1 Unfortunately, routes that take you off-site are not accessible but many of the events and activities on the main site are. Anyone wishing to compete in a wheelchair are asked to contact the organisers in advance to confirm if the route is accessible.

6.2 Entries from blind or visually impaired participants are welcome provided they are accompanied by a sighted participant. If this Condition applies to you please email us at info@eventsofthenorth.com for further information.

7.0 ENTRY POLICY – ALL TICKET HOLDERS

7.1 To access the festival site, you must hold a valid ticket. Your ticket, in the form of a wristband, must be worn at all times and is for your use only. DO NOT remove or give this wristband to anyone else. Failure to comply to this rule will result in you being asked to leave the site immediately. Failure to produce the appropriate receipt/ticket or pass, when so requested, may result in removal from the festival site, without later claim or compensation.

7.2 Upon arrival to site, all ticket holders will need to register and will be presented with their waistband and race number (if applicable). All ticket holders and guests must consent to a security search of bags and any other items deemed necessary.

7.3 Prohibited items or any items that the event organisers deem to be a risk to safety, enjoyment of others or security or are not suitable to be taken to the event or may be used in an illegal or offensive manner (regardless of whether the item itself is illegal) are not allowed. Ticket holders may be ejected if found in possession of prohibited items inside the event. Prohibited items include but are not limited to:

  • Alcohol – unless in the designated campsite, no alcohol purchased off-site is allowed in the festival grounds.
  • Illegal substances.
  • Drones, lasers, unauthorised professional film or video equipment or large stereo systems.
  • Air Horns.
  • Fireworks, flares or Chinese Lanterns.
  • Any item which may reasonably be considered for use as a weapon.
  • Gas Canisters

7.4 No refunds will be offered to customers who are refused entry or removed from the site.

7.5 Dogs are allowed on the festival site, so long as they are on the lead at all times. Dogs must be well-behaved, and crew reserve the right to ask misbehaving dogs to leave the site with no notice and without ticket refund.

7.6 Bikes on site are permitted only when in use at one of the cycling events. Please do not cycle around the main festival site. Please ensure your bike is locked up when not in use or left at one of the designated bike zones.

8.0 WEEKEND CAMPING TICKET HOLDERS

In order to use the Wild GOAT Festival campsite and facilities, you hereby agree to the following terms and conditions.

8.1 Tickets & Wristbands

8.1.1 You must hold a valid weekend family or individual ticket to camp on the site. Your ticket, in the form of a wristband, must be worn at all times and is for your use only. DO NOT remove or give this wristband to anyone else. Failure to comply to this rule will result in you being asked to leave the site immediately.

8.1.2 There must be at least one over 18 adult per group, no unsupervised under 18 groups will be allowed to stay.

8.1.3 A Weekend Family Ticket includes two adults (over 16 years of age) and three children (aged 7 – 15 years of age.) Under 7’s are free of charge but must hold a valid wristband.

8.1.4 Your wristband will give you access to the food / catering tent at the designated times outlined in your race guides.

8.2 Arrival & Departure by Vehicle

8.2.1 Please follow signs for Weekend Camping when you are arriving to site, crew will be on site to guide you.

Upon arrival, please head to the Camping Registration tent in the car park to check in. When you have checked in, you will be asked to unload all of your personal belongings and camping equipment in the car park. It is then a short 3-4 minute walk to the campsite where a member of the crew will assign you a pitch. Vehicles are not permitted within the campsite at any time.

8.2.2 Please ensure you stay in your designated pitch to avoid disturbing your fellow campers or disrupting emergency access lanes. You must adhere to the ‘four metre rule’ between pitches to protect against the spread of fire.

8.3 DO NOT more any markers or guide ropes erected by the festival organisers.

8.4 Motorhomes, Campervans and electric hook-ups

We will allow campervans but no caravans on site. We will not have any electric hook-up points available on site.

8.5 Gazebos

Gazebos are not allowed on site as we can’t guarantee safety anchor. We will allow awnings fixed to the sides of campervans.

8.6 Bikes

Please make sure your bike is locked up when not in use. If possible, secure to an anchor point or leave at a designated bike zone. When cycling around the campsite please take into consideration pedestrians of all ages will be in the vicinity. You have a duty of care to cycle in a safe and proper manner and we advise always wearing a helmet. Cycling within the main festival site is not permitted outside of designated events / activities. E-bikes are not permitted on site.

8.7 Shower and toilets

Showers and Toilet blocks will be clearly signposted and highlighted on your site map. Please respect others when using the facilities leaving them in a clean and respectable manner. Personal chemical toilets are not permitted on site. Showers will only be available to those holding weekend camping passes.

8.8 BBQ’s & Open Fires

8.8.1 BBQ’s and open fires are not permitted on site. DO NOT attempt to bring any BBQ’s on site. Security will be instructed to put out any fires or BBQ’s found in the campsite immediately and you will be reported to a member of the crew. Failure to comply with this rule may result in immediate removal from site.

8.8.2 Camping stoves and gas canisters are not permitted on site.

8.9 Generators are not permitted on site.

8.10 Glass Bottles are not permitted on the campsite or in the main festival site.

8.11 Alcohol

Alcohol purchased off-site is not permitted. Please note that in the main festival arena/village, security reserve the right to confiscate any alcoholic drinks not purchased at Wild GOAT Festival. We cannot be held responsible for returning the alcohol to you or for refunding any costs incurred by you.

8.12 We respectfully ask that any noise or disturbance after 11pm is kept to an absolute minimum, for the sake of fellow campers, their families, and our surrounding villagers.

8.13 Please, no foraging for wood in the camp field or adjacent fields.

8.14 Please take all waste home with you. Persons found dumping will be charged. Love the site - LEAVE NO TRACE. Alternatively, take your un-recycled waste home with you.

8.15 Well-behaved dogs are allowed on site but must be kept on a lead at all times.

8. 16 The site should be cleared by noon on the day of your departure unless permitted otherwise by the Crew. Please ensure that you have all your camping equipment before you depart the site, including tent pegs, which cause injury to our animals if left in the ground. (LEAVE NO TRACE)

8.8 Security and Health & Safety

We will have someone on the campsite 24 hours / day. This person will be first aid trained and have access to contact the emergency services should a situation arise. Lost property will be located in the same area, please refer to your site map for more information. Please note, all items on site are brought and left at your own risk. A fire assembly point will be clearly signposted and detailed in your information pack.

9.0 FEES & OTHER

9.1 All Fees are inclusive of VAT.

9.2 A processing fee may be added to the credit/debit card booking at the time of registration which is in all cases non-refundable.

9.3 If your entry is accepted the Fees are non-refundable other than where the event or any of the activities is cancelled by us as set out in these Terms & Conditions.

9.4 The Contract shall be governed by English law, and the parties submit to the exclusive jurisdiction of the English courts.

9.5 If any provision of these Conditions is invalid or unenforceable, in whole or in part, the validity or enforceability of the remainder of these Conditions shall not be affected.

9.6 These Conditions do not create, confer or purport to confer any benefit or right enforceable by any third party whether under the Contract (Rights of Third Parties) Act 1999 or otherwise. 

9.7 Nothing in these Conditions shall have the effect of holding the Partners out as being a partnership, joint venture, principal or agent of each other or of us.

9.8 References in these Conditions to “include” and “including” are to be construed without limitation. 

10.0  CANCELLATION BY YOU 

10.1 The Fees are non-refundable, and other than as set out in Condition 9.3, are non-transferable. No exceptions.

10.2 Once we receive and accept your entry, you will not receive a refund if you cannot participate, you may not give or sell your race number to anyone else.

10.3 If you are unable to participate in the event for medical reasons, you may defer your entry to the same event the following year provided you inform us no later than 4 weeks prior to the Race Date and provide us with a letter from your doctor or physiotherapist (by post or by email to the relevant address set out in the Registration Form) setting out the reason for such deferral. Where the same event does not take place the following year, you may use your deferral to enter a race of the same or equivalent distance organised by us. 

11.0 CANCELLATION BY US 

11.1 We may cancel the event if circumstances beyond our reasonable control arise, including, war, civil or political unrest, terrorism, government and/or local authority/ council intervention or inclement weather conditions.

11.2 We may cancel the event if one month before the event date we have not, in our sole discretion, received a sufficient number of participants to make the event economically viable.

11.3 In such circumstances as set out in Conditions 11.1 and 11.2:-

11.4 We will, if practicable, provide written notice of cancellation to the address we hold for you. In the event that written notice is not practicable due to the timescales involved we will use reasonable endeavours to provide other suitable methods of notice including, e-mail, television and radio broadcasts; and

11.5 You will receive a refund of the Fee (other than the processing fee which is at all times non-refundable).

11.6 In the event of cancellation of the event as set out in Conditions 11.1 and 11.2, we will have no responsibility for any costs incurred as a result of cancellation including any travel or accommodation costs, including your travel to the event location.

11.7 For the avoidance of doubt, any change to the event date, the event schedule, the event format and/or any other change to the event, that at our discretion, we consider necessary to stage the event under shall not constitute a cancellation of the event by us and no refund of the Fees (in whole or in part) shall be given to you in the event of any such change, other than in the case of cancellation by us as set out in Conditions 11.1 and 11.2. 

12.0 DATA PROTECTION

12.1 For the purposes of this Condition 12.0 personal information includes any information provided by you when completing the Registration Form and (where applicable) medical data collected for health and safety purposes (“Personal Information”).

12.2 You agree that your Personal Information can be stored and used by us in connection with the organisation, staging and administration of the event. Further you agree that any medical information provided in your Registration Form may be used to treat or otherwise assist you as a result of illness or injury sustained arising from your participation in the event and/or used by assisting medical staff where deemed necessary. You agree to inform us of any change in your medical condition from the date of completion of the Registration Form up to and until the start of the event which is likely to affect your ability to participate in the event.  

12.3 You agree that your Personal Information may be anonymised and the anonymised data may be used by us in connection with the compilation of statistical information and to improve health and safety procedures at future events.

12.4 Where on the Registration Form you have opted-in to receive marketing information from us and our Partners, you agree that your name and contact details can be used by us and our Partners for the purposes of:-

12.4.1 the promotion and marketing of the Race; and

12.4.2 adding you to a mailing list to keep you informed about any future events and services which we believe you might be interested in, such as leisure activities relating to similar types of events or activities (Together the “Marketing Information”). 

12.4.3 We agree to hold your Personal Information in accordance with our privacy policy. 

13.0 LIABILITY

13.1 You acknowledge and agree that you participate in the event at your own risk.

13.2 Subject to Condition 10.0, we shall not be liable to you and/or to your heirs and successors in title in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise for any: (A) (i) loss of profits, (ii) loss of business, (iii) anticipated savings or wasted expenditure, (iv) loss of earnings, (v) loss or damage of or to personal equipment belonging to you, and/or(vi) any kind of physical, mental or other loss or damage of whatsoever nature, (whether in each case of (i) – (vi) arising directly or indirectly); and/or (B) any indirect or consequential loss, arising out of your participation in the Race and/or any other matter arising under these Conditions. 

13.3 Subject to Condition 13.0, our total aggregate liability to you arising out of or in connection with your participation in the event and/or any other matter arising out of or in connection with these Conditions shall not exceed an amount equal to the Fees paid by you pursuant to these Conditions at the time of such liability arising. 

13.4 Nothing in these Conditions excludes or limits our liability: (i) for death or personal injury caused by our negligence, (ii) for fraud or fraudulent misrepresentation, or (ii) to an extent greater than is permitted under law. 

I (and your parent/guardian if under the age of 18 years) agree and accept all the conditions of entry and acknowledge that the organisers shall not be liable for death, personal injury, or loss or damage as a consequence of my participation in this event, except with regard to death or personal injury which is caused by the organiser's negligence.
